The United Kingdom has announced major changes to its permanent residency rules, with most migrants expected to wait 10 years instead of five before qualifying for indefinite leave to remain (ILR).

The Home Office unveiled the new Earned Settlement model on Monday, November 2, 2026, placing greater emphasis on migrants’ financial contributions, employment records and compliance with immigration laws.

Under the new framework, the standard qualifying period will double from five to 10 years. However, some migrants will retain shorter settlement routes, while others could face waiting periods of up to 30 years.

The announcement is particularly relevant to Kenyans working, studying and living in the UK, many of whom hope to obtain permanent residency.

UK introduces new 10-year permanent residency rule

The Earned Settlement model will replace the existing five-year standard route for most eligible migrants.

Under the new system, applicants will have to demonstrate that they have contributed to British society and met specific conditions before qualifying for permanent residency.

The government says settlement will depend on factors such as employment, income, immigration compliance and personal conduct.

The changes also introduce different qualifying periods depending on individual circumstances.

According to the Home Office, the highest earners could qualify after three years, while certain skilled workers and public service employees will retain a five-year route.

Which migrants will qualify for UK permanent residency after five years?

The proposed framework retains shorter settlement periods for selected categories of migrants.

These include:

  • Higher earners: Migrants earning more than £50,271 annually will qualify for the five-year route.
  • Public service workers: Certain professionals in healthcare and education, including doctors, nurses and teachers, will retain the five-year pathway.
  • Care workers: Eligible care workers who meet their visa conditions and earn at least £25,000 annually will qualify under the five-year arrangement.
  • Refugees on approved routes: Those entering through government-approved safe and legal routes will qualify after five years.

The government has also introduced a three-year settlement pathway for exceptional high earners earning more than £125,000 annually and people arriving through designated high-talent schemes.

Some migrants could wait 20 to 30 years for permanent residency

The new framework introduces longer settlement periods for migrants who breach immigration rules.

Those who commit immigration breaches could face a minimum qualifying period of 20 years.

Refugees who do not arrive through approved safe and legal routes will generally face a 20-year settlement period. Those who enter through small boats or other clandestine methods could face an additional 10 years, bringing the total waiting period to 30 years.

However, refugees who enter employment or education may qualify for reductions in their waiting periods, depending on their circumstances.

UK introduces stricter conditions for permanent residency

Under the Earned Settlement model, completing the required number of years in Britain will no longer be sufficient on its own.

Applicants will have to meet four mandatory conditions before qualifying for permanent residency.

These include:

  • A clean criminal record.
  • A high standard of spoken English, equivalent to A-level English as a foreign language.
  • No outstanding debts owed to the British taxpayer.
  • A record of sustained National Insurance contributions.

Applicants will also have to meet the applicable Life in the UK Test and other settlement requirements.

The government has made clear that migrants who fail the mandatory conditions could be denied settlement even after completing the required residence period.

Migrants who claim benefits face additional restrictions

The reforms also introduce conditions for migrants who have relied on public benefits.

Under the announced framework, applicants who have claimed benefits must complete five continuous years without relying on the state before submitting their settlement applications.

This means that claiming benefits does not automatically result in a 20-year waiting period, but it could affect when an individual becomes eligible to apply.

What the new UK immigration rules mean for Kenyans

The changes could affect Kenyans who moved to Britain for employment, education and other immigration opportunities.

Those earning below the higher-income threshold will generally fall under the new 10-year standard route, subject to the applicable rules and exceptions.

Kenyans working in healthcare and education could retain the five-year pathway if their occupations and circumstances meet the government’s requirements.

Care workers may also qualify for the shorter route if they satisfy the relevant conditions.

Migrants already living in Britain should also pay attention to the implementation arrangements. The government has indicated that settlement rules will generally be assessed under the requirements in force when an application is decided, rather than those in force when someone first arrived.

The government says no one who already holds settled status will lose it under the reforms. It also says migrants who need more time will be able to renew their temporary visas, provided they meet the relevant requirements.

The changes will therefore make the route to permanent residency longer for many migrants, while placing greater emphasis on income, employment, immigration history and compliance with British laws.
