Please read these Terms of Use (“Terms”) carefully before using the independent.co.ke website (the “Site”) operated by The Independent Kenya (“us,” “we,” or “our”).

Your access to and use of the Site is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Site.

By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Site.

The Site and its original content, features, and functionality are and will remain the exclusive property of The Independent Kenya and its licensors. Our content is protected by copyright, trademark, and other laws of Kenya and foreign countries.

We may terminate or suspend your account and bar access to the Independent Kenya immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of our Terms of Use.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Nairobi, Kenya.

10. Changes to Terms

Independent Kenya reserve the right, at our sole discretion, to modify or replace Our Terms of Use at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site after those revisions become effective, you agree to be bound by the revised terms.
