Kapseret MP Oscar Sudi: ‘I Never Claimed I Went to School’

    Kapseret Member of Parliament Oscar Sudi has made a candid statement regarding his academic background, nearly a year after being acquitted in a high-profile forgery case linked to his Kenya Certificate of Secondary Education (KCSE) qualifications.

    Speaking on Sunday, April 14, the legislator appeared to concede that he had never attended school, a remark that has reignited public scrutiny over the previous allegations.

    “You’ve heard people say I didn’t go to school—do you think they are lying? Have you ever heard me claim anywhere that I went to school?” Sudi posed. “But when you come to my constituency, I have delivered because of my experience.”

    He went on to compare himself with other leaders, notably Kikuyu MP Kimani Ichung’wah, who studied at the prestigious Alliance High School.

    “Kimani Ichung’wah was lucky to go to school. Some of us didn’t get that chance,” he remarked.

    In 2015, the Ethics and Anti-Corruption Commission (EACC) launched investigations into Sudi’s academic credentials following claims that he had submitted falsified documents to the Independent Electoral and Boundaries Commission (IEBC) during his 2013 parliamentary campaign.

    The EACC’s findings indicated that both his KCSE certificate and a diploma in Business Management from the Kenya Institute of Management (KIM) were fraudulent.

    As a result, the Director of Public Prosecutions (DPP) charged Sudi in 2016 with multiple offenses, including forgery, providing false information, and making a false statutory declaration.

    Sudi challenged the charges in court, arguing that his constitutional rights had been violated. However, the High Court dismissed his petition in 2018, and the Court of Appeal upheld the decision, allowing the criminal trial to proceed.

    A three-judge bench—comprising Justices William Ouko, Wanjiru Karanja, and Asike Makhandia—noted that the constitutional petition did not invalidate the ongoing proceedings in the magistrate’s court.

    During the trial, 14 witnesses testified, including officials from Highway Secondary School and the Kenya Institute of Management. Their evidence showed that Sudi’s name was absent from the 2006 KCSE candidates list at Highway Secondary, and the diploma certificate bore an admission number belonging to another individual.

    The investigating officer further testified that the documents were forgeries and had been presented to authorities during a meeting in Nairobi.

    Despite the testimonies, on June 7, 2024, Chief Magistrate Felix Kombo acquitted Sudi of all charges. The court found that the prosecution had failed to prove its case beyond a reasonable doubt. Magistrate Kombo also noted that some of the evidence had been improperly obtained.
