Justin Muturi Blows Whistle on Illegal Govt Scheme Enriching MPs

Former Public Service Cabinet Secretary and Attorney General Justin Muturi has once again voiced strong criticism against the government, this time targeting the National Government Constituency Development Fund (NG-CDF). He questioned the constitutionality of the fund and called for its immediate abolition.

In a sharply-worded statement, Muturi argued that the continued implementation of the NG-CDF, despite court rulings declaring it unconstitutional, is unlawful. He emphasized that the programme has historically been misused to benefit Members of Parliament at the expense of ordinary citizens.

Muturi, who once held the position of Attorney General—a role charged with advising the government on the legality of its actions—stated unequivocally that the NG-CDF should be scrapped.

“NG-CDF is a corrupt, unlawful and unconstitutional slush fund to unjustly enrich the MPs, their families and cronies and should, therefore, be scrapped,” he asserted.

His remarks follow a ruling issued in September last year by High Court judges Kanyi Kimondo and Roselyn Aburili, who declared the NG-CDF unconstitutional. The ruling significantly weakened MPs’ influence by stripping them of a tool often used for political patronage.

In response, Members of Parliament announced on September 22 their intention to appeal the ruling. They expressed concern that the decision would block their access to billions of shillings allocated to the fund beyond June 30 this year.

The National Assembly, in a formal statement, confirmed that its legal team had requested the court judgment and proceedings. They intend to challenge all findings related to the NG-CDF Act 2015 at the Court of Appeal.

This is not the first time Muturi has publicly clashed with the government. On April 4, he accused President William Ruto of attempting to pressure him into approving a questionable Ksh129 billion deal with Russian investors.

The deal, valued at approximately $1 billion, was reportedly aimed at financing the planting of three billion trees under the government’s broader 15-billion-tree initiative. Muturi claimed the president urged him to endorse the agreement while he was still at the airport, without affording him the opportunity to review the documentation.

The alleged incident occurred during Muturi’s travel for the December 2023 COP28 Summit in Dubai. He stated that while still at the airport en route to the summit, he received a direct phone call from the president concerning the deal.
